These terms govern your use of the PowerAether Intelligence website and newsletter subscriptions. By subscribing or using this website, you agree to these terms.
1. Who we are
PowerAether Intelligence ("we," "us," "the publisher") is a sole proprietorship (autónomo) registered in Madrid, Spain. The publisher operates two biweekly newsletters: PowerAether Intelligence — North America Edition, and PowerAether Intelligence — Europe Edition.
2. The service
We provide a biweekly intelligence briefing in PDF format covering regulatory and grid-connection developments affecting the data center sector. Each issue contains independently researched analysis sourced primarily from regulatory dockets, official orders, law-firm alerts, and trade press.
Free subscribers receive: a public preview article from each issue, plus access to all PDF issues older than 90 days.
Paid subscribers receive: every biweekly PDF issue delivered to their email inbox on publication day, plus access to the full archive.
3. Subscriptions
3.1 Free subscription
PowerAether Intelligence is currently provided as a free biweekly newsletter. Subscribing requires only an email address; no payment information is collected. There are no subscription fees, no auto-renewal, and no charges of any kind. You may unsubscribe at any time.
3.2 Future changes
We may introduce paid subscription tiers in the future. If we do, we will provide at least 30 days' advance notice by email to all active subscribers, with full details of any pricing or service changes. The free tier will continue to be available in some form. You will never be charged without your explicit consent and an active payment method on file.
3.3 Service changes and discontinuation
We may change, suspend, or discontinue any aspect of the service at our discretion, with reasonable advance notice to active subscribers where practicable.
4. Cancellation
You may unsubscribe at any time using the unsubscribe link at the bottom of any newsletter email, or by emailing info@poweraether.com. Unsubscription is processed within 7 days, and your data is deleted in line with our Privacy Policy.
We may cancel a subscription at our discretion if you violate these terms.
5. Acceptable use
You agree to use our newsletters and website only for lawful purposes. You agree NOT to:
- Forward, share, redistribute, or publish the PDF newsletters in whole or in significant part to non-subscribers. Each subscription is for one individual reader.
- Resell or sublicense the content. Team distribution requires a separate arrangement — contact us.
- Train AI/ML models on the content without express written permission.
- Scrape, mass-download, or systematically extract content from the website.
- Misrepresent our analysis or attribute fabricated quotes to us.
- Use the content in a way that competes directly with PowerAether Intelligence (e.g., creating a competing newsletter substantially derived from ours).
You may quote brief excerpts (under 150 words) with proper attribution and a link to poweraether.com. You may share the publicly available website articles freely.
6. Intellectual property
All content in our newsletters, website, and related materials is the intellectual property of PowerAether Intelligence (or our licensors), protected by Spanish and EU copyright law. We retain all rights not expressly granted in these terms.
We use third-party trademarks (e.g., FERC, ERCOT, BNetzA) solely for editorial reference; their use does not imply affiliation or endorsement.
7. Editorial standards and disclaimers
7.1 Editorial accuracy
We make reasonable efforts to ensure the accuracy of all information in our newsletters. Each issue is sourced from primary regulatory documents and verified by independent industry counsel before publication. When we identify errors, we publish errata in the next issue and on the website.
7.2 Not legal, financial, or investment advice
The content of PowerAether Intelligence is for informational purposes only. It is not legal advice, financial advice, investment advice, or professional advice of any kind. We are not a law firm, financial advisor, or registered investment advisor. You should consult qualified professionals before making decisions based on our content.
7.3 Forward-looking statements
Our analysis includes forward-looking views about regulatory developments, deal flow, and market dynamics. These are estimates based on publicly available information at the time of writing. Actual outcomes may differ materially. We do not guarantee any particular outcome.
8. Liability
To the maximum extent permitted by Spanish law, our total liability to you for any claim arising from your use of our service is limited to the amount you have paid us in the 12 months preceding the claim.
We are not liable for: indirect or consequential losses; lost profits; lost business opportunities; lost data; or any losses you suffer because you relied on our content for a regulatory, investment, legal, or business decision.
Nothing in these terms limits liability that cannot be limited under Spanish law (e.g., for fraud, gross negligence, or personal injury caused by negligence).
9. Service availability
We make reasonable efforts to deliver newsletters on the published schedule, but we do not guarantee uninterrupted service. We may delay or suspend publication for technical, editorial, or force majeure reasons (e.g., illness, infrastructure outages, vendor failures).
If we miss a scheduled publication date by more than 14 days for non-force-majeure reasons, paid subscribers may request a pro-rated extension to their subscription.
10. Changes to these terms
We may update these terms from time to time. Material changes will be communicated by email to all active subscribers at least 30 days before they take effect. If you do not agree to the updated terms, you may cancel your subscription before they take effect.
11. Governing law and disputes
These terms are governed by the laws of Spain. Any dispute arising from these terms or your use of our service will be subject to the exclusive jurisdiction of the courts of Madrid, Spain.
